Welcome to CompanionCare. These Terms of Service ("Terms") govern your access to and use of the CompanionCare platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
CompanionCare is a platform that connects trained companions with elderly clients ("Care Recipients") in South Florida. We facilitate scheduling, communication, and management of in-home companionship visits. CompanionCare is not a medical provider and does not provide medical care, nursing services, or home health aide services.
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
The Service supports three types of users:
Companions provide non-medical services including but not limited to: companionship, conversation, light housekeeping, meal preparation assistance, medication reminders (non-administration), transportation assistance, and wellness observation. Companions are not licensed medical professionals and do not provide medical treatment or diagnosis.
Visit schedules are managed through the platform. Cancellations must be made at least 48 hours prior to the scheduled visit. Late cancellations may be subject to fees as outlined in your service agreement. CompanionCare reserves the right to reschedule visits due to companion unavailability or other operational needs.
Fees for services are based on your selected subscription plan. Payment is processed through our secure payment processor (Stripe). By subscribing, you authorize recurring charges. You may cancel your subscription at any time, effective at the end of the current billing period.
All companions undergo background verification before being approved to provide services. However, CompanionCare does not guarantee the accuracy or completeness of background check results and does not assume liability for the actions of any companion.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.
The Service may collect and store health-related information about care recipients to facilitate appropriate companion care. This information is handled in accordance with our Privacy Policy and applicable health information privacy regulations.
CompanionCare is a technology platform that facilitates connections between families and companions. We are not liable for any injuries, damages, or losses arising from companion visits. Our total liability shall not exceed the fees paid by you in the twelve months preceding any claim.
You agree to indemnify and hold harmless CompanionCare, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Broward County, Florida.
